TERMS OF SERVICE
Account Holder Agreement
The following describes the terms and conditions upon which “7th Element” provides service to “Account Holder” (person establishing and financially obligated to Participant account) and “Participant” (person utilizing 7th Element food services). This agreement is a legal contract between 7th Element and Account Holder and governs Account Holder use of our services. If you do not agree to the “Terms of Service” in this Agreement, please do not use 7th Element services.
Acceptance of Terms
In order to use our service Account Holder must agree to be bound to all terms and conditions set forth in this Agreement, which include those terms and conditions set out below and those incorporated by reference. 7th Element advises that you carefully read this Agreement and all 7th Element pages referred to in this agreement, as they may contain additional terms and conditions that apply to you as an Account Holder of 7th Element. By utilizing this website for ordering (or, for paper orders from Account Holders, executing the Account Sign Up form), you acknowledge that Account Holder understands and agrees to be legally bound by all of the terms and conditions set forth in this Agreement and the Privacy Policy. If you do not agree to all of the terms, you will not be allowed to complete an order or to use our services. 7th Element may amend this Agreement at any time. 7th Element will post the amended terms on the 7th Element website and notify Account Holder via email at the email address Account Holder provided or at login by Account Holder if such terms change. Account Holders continued use of our services following any amendments constitutes acceptance of the amended agreement. Account Holder can access the Terms of Service Agreement at www.The7thElement.com or by mailing 7th Element at 7310 Varna Avenue, Suite B, North Hollywood CA, 91605, and requesting a copy to be mail or faxed. 7th Element owns all rights, title and interest to all materials and content contained on 7th Element website and published materials, including web site design, code, content, logos, digital photography, text, and graphics, our materials and content are protected by trademark and other intellectual property laws. Any unauthorized use is prohibited.
General Information
It is the purpose of 7th Element, a food preparation service, to offer a vegan menu based on Macrobiotic Principles. Our dishes are created using organic ingredients, (when available), and there are absolutely no animal products of any kind in our prepared foods.
The Account Holder and/or Participant of food purchased from 7th Element is assured that all food is prepared in compliance with the general standards of health and safety for the food industry in the County of Los Angeles, State of California. However, all items on the menu may not be appropriate for all individuals, particularly those with food sensitivities and/or special dietary requirements. Consumers with known or unknown food allergies and/or specific health conditions may be unable to tolerate certain foods offered on our menu. Individuals with known or unknown food allergies and/or specific health conditions may order from this menu at their own risk and at their sole discretion. 7th Element and its employees are neither dieticians, physicians nor other health care providers, and make no representation or warranty as to the compatibility or the suitability of our foods with any health requirements of any customer. Please consult your own physicians with regard to all health matters related to your food choices. By purchasing items from this menu, the Account Holder hereby acknowledges that Account Holder has made an independent assessment of the suitability of such items for the health or dietary needs of the Participant/Consumer.
Cancellation Policy and Refund Policy
To cancel orders please send an email to . Email cancellation requests must be done by midnight of the day prior to your receipt of food. For example if you wish to cancel your order for Thursday’s meal service this must be done by midnight on Wednesday evening. In your e-mail please include the following: first and last name, order number, email address and the day you wish to cancel service for. This information must be identical to the information originally submitted on your order. Every effort will be made to accommodate the cancellation of your order. Your account will be credited for the cancellation. This credit may be used for future food service purchases over the next 30 days, we do not do refunds.
